Council approves several planning-related changes

July 13, 2023

Council for the County of Prince Edward recently made three planning-related decisions.

Official Plan Amendment 2

Council passed Official Plan Amendment 2 By-law No. 115-2023. The amendment updates the Official Plan so that it is consistent with new legislation and the Provincial Policy Statement. The amendment also keeps the Official Plan current with local needs. The amendment makes changes affecting all properties within the municipality.

Pre-consultation and Complete Application By-law

Council passed Pre-Consultation and Complete Application By-law No. 116-2023, repealing the previous pre-consultation by-law. The new by-law:

  • Updates the requirements for mandatory pre-consultation prior to the submission of various applications under the Planning Act
  • Provides greater transparency and clarity around the requirements of a complete application under the Planning Act
  • Delegates authority to the Director of Development Services for determining a complete application

Site Control By-law

Council passed Site Plan Control By-law No. 119-2023, repealing the previous site plan control by-law. The updated by-law:

  • Defines various terms used in the by-law
  • Updates the zone categories where site plan control may be applied
  • Provide provisions related to the types of development where site plan control is applicable
  • Includes provisions to identify Major Site Plan Control applications and Minor Site Plan Control applications
  • Establishes exemptions to site plan control in accordance with the Planning Act local needs
  • Establishes application requirements in accordance with the Planning Act and the municipality’s Pre-Consultation and Complete Application By-law
  • Outlines the information that is required with the application
  • Addresses enforcement, penalties, and the release of securities associated with the Site Plan Control process
