The Interim Control By-law Z7-23 is initiated by the municipality, affecting various locations within Prince Edward County.
The proposed Interim Control By-law Z7-23 would prohibit development in areas where shoreland designation overlaps areas with natural heritage features for a period of one year to give the municipality time to conduct a review/study of these areas.
Background
This interim control by-law is coming forward as a result of a motion passed by Council at the Planning and Development Committee meeting on March 22, 2023. Motion 2023-204 read:
WHEREAS Council directed staff to conduct a review of the Shoreland designation when the new Official Plan was approved through motion CW-427-2020;
AND WHEREAS Council reaffirmed approval for this review that has yet to be completed, as a project in the 2023 Budget;
AND WHEREAS Amendments to the Official Plan will be permitted after July 2023 following the 2-year moratorium; and
NOW THEREFORE BE IT RESOLVED THAT Council direct staff to bring forward a report to implement an Interim Control By-law regarding development within Natural Heritage Areas as identified in the Official Plan within the Shore Land designation to the May 17th Planning & Development Committee meeting for consideration by Council no later than June 27, 2023.
